The requirements of ValuedShops.de correspond to the Netherlands. We have summarized these on our page with German requirements so that you can easily check your own webshop. Importantly, our check is based on universal European requirements and is not a comprehensive check based on German law.

Abmahnung

Unlike in the Netherlands, competitors can fine each other in Germany. So it is highly recommended to have your online store checked by a German lawyer before it goes online. This is because the risk of fines in Germany is many times higher than in the Netherlands.

Art. 12(1) UWG (German law against unfair competition):

"Die zur Geltendmachung eines Unterlassungsanspruchs Berechtigten sollen den Schuldner vor der Einleitung eines gerichtlichen Verfahrens abmahnen und ihm Gelegenheit geben, den Streit durch Abgabe einer mit einer angemessenen Vertragsstrafe bewehrten Unterlassungsverpflichtung beizulegen. Soweit die Abmahnung berechtigt ist, kann der Ersatz der erforderlichen Aufwendungen verlangt werden."
