As a merchant, it is essential to clearly inform customers of their rights and obligations around returns. This is not only important for good customer service, but also required by law. Below we explain how the right of withdrawal works, what you should state as a minimum in your return policy, and provide sample texts that you can use or adapt to your situation.

It is obligatory to inform your customers about the right of withdrawal (return policy) within your webshop outside the general terms and conditions. Even if no right of withdrawal applies to your products, this must be mentioned. If you do not do this, then the customer has no less than 12 months after purchase to return free of charge.

The minimum you need to mention in the return policy is:

- Does the right of withdrawal apply? For which products does/doesn't it apply?

- How can the customer exercise their right of withdrawal?

- When does the right of withdrawal expire?

- That the entire order amount is refunded within 14 days after notification of return (this is required by law).

- Does the customer have to pay return costs themselves?

Standard text reflection and return policy

You can use the following texts in standard cases to point out the following actions to your customer:

Right to return:
"You have the right to cancel your order up to 14 days after the day of receipt without giving a reason. You have another 14 days after cancellation to return your product. You will then be credited for the full order amount including shipping costs. Only the return costs from your home to the store are for your own account. These costs are approximately 7.25 per package, for the exact rates please consult the website of your carrier. If you exercise your right of withdrawal, the product will be returned to the entrepreneur with all delivered accessories and - if reasonably possible - in its original condition and packaging. To exercise this right, please contact us at UWEMAIL@uwwinkel.nl. We will then refund the order amount due within 14 days of notification of your return, provided the product has already been received back in good order. Should the product be damaged or the packaging more damaged than necessary to try the product, we may pass this depreciation of the product on to you. So please treat the product with care and make sure it is properly packaged when you return it."
Product exchange:
"Would you like to exchange your product? That is not a problem at all. You can contact [E-MAILADRES] to do this. However, you will have to bear the cost of returning the product."
Incorrect delivery address provided:
"Incor
rectly
provided a wrong delivery address? If so, please contact us as soon as possible. We will then still try to change the order for you."

Customization exception

Are your products excepted because you sell only custom-made products? Then you can point this out to your customer with the following text:

"Products you buy through this online store are custom made according to the specification you entered. The right of withdrawal is therefore not applicable. The sale is thus final after successful payment."

Sealed products exception

You are allowed to seal products under certain circumstances, these include products that cannot be returned after opening for hygienic reasons. These products may be returned as long as the seal has not been broken:

"For audio and video recordings, computer software, and products that are not suitable to be returned for reasons of health protection or hygiene, you have the right to cancel your order up to 14 days after the day of receipt without giving a reason, provided the seal has not been broken. When the seal is broken, your order is final and cannot be returned. Should you exercise your right of withdrawal, you have another 14 days after cancellation to return your product. You will then be credited for the full order amount including shipping costs. Only the return costs from your home to the store are for your own account. These costs are approximately 7.25 per package, for the exact rates please consult the website of your carrier. If you exercise your right of withdrawal, the product will be returned to the entrepreneur with all delivered accessories and - if reasonably possible - in its original condition and packaging. Shelf life exception

Are your products exempt because they only have a short shelf life? Think for example of fresh products. Then you can point this out to your customer with the following text:

"Products you buy through this online store have only a limited shelf life and therefore cannot be returned. The right of withdrawal is therefore not applicable. The sale is thus final after successful payment."

Always point out the right of withdrawal!

It is mandatory to point out your visitor's rights. Even if the right of withdrawal does not apply, you should mention this outside the general terms and conditions within your webshop! Feel free to contact us with any questions.
