Besides mentioning the cooling-off period in the general terms and conditions of your webshop, you also have the obligation as a merchant to point out this right to the customer outside the general terms and conditions. This can be done on a separate page called, for example, Revocation or Returns. We have handy sample texts available here that you can copy

Do I have to be a member to use the sample documents?

No, there are special sample documents of general terms and conditions for web shops available for non-members. You can easily download them with the link above and use them on your webshop. Of course we encourage you to become a member to take advantage of all the benefits membership offers.

I want to become a member, which terms and conditions should I use?

As a member you will find the terms and conditions within the dashboard. The difference with the public terms and conditions is that the terms and conditions for members refer to our dispute mediation. If you are currently going through the registration process, you can already use the member terms and conditions.

What about products without a cooling-off period?

Are you selling products where the statutory cooling-off period does not apply? No problem! The general terms and conditions for your webshop contain the legal exceptions such as sales of customized or perishable products. In that case, you can simply use these conditions, but do state clearly on a customer service page that the right of withdrawal does not apply (for certain products). Why are terms and conditions important for your shop?

Terms and conditions state the rights and obligations of both your customer and yourself. This creates clarity for both you and your customer and prevents legal discussions in the future. General terms and conditions include how the cooling-off period works, what the exceptions to this are, how you deal with guarantees, that the consumer has an obligation to pay and how you deal with complaints. Besides stating these things in the general terms and conditions, it is important that you also state these things clearly elsewhere, for example with our sample texts

Can I change the terms and conditions of my web shop myself?

You may make changes to the terms and conditions, it is just (legally) not allowed to put things in your terms and conditions that are unreasonable or conflict with the law. As a rule, you may not give consumers fewer rights than those provided by law.

To give an example: the minimum cooling-off period is 14 days; you may extend it to 30 days, but you may not reduce it to 10 days. The law also stipulates which exceptions apply to the cooling-off period; you may not make up your own exceptions that do not fall under the legal exceptions

We therefore recommend that you use the terms and conditions as they stand when you have no compelling reasons to make changes. This will ensure that the terms and conditions comply with the applicable regulations.
